Illigal For Minors to open Facebook And Google Accounts:Petition



The Delhi High Court on Thursday asked the Union government to explain how it was allowing children below 18 years to open accounts in social networking sites such as Facebook and Google.

A Division Bench of Justices B.D. Ahmed and Vibhu Bakhru asked the Centre to respond within 10 days when counsel for the former BJP leader, K.N. Govindacharya, the petitioner in the matter, accused the two sites of not verifying the details of its subscribers. It posted the matter on May 13 for further hearing.

The court has been seized of the petition since June 2012.

The Bench also impleaded Facebook Inc. and Google Inc. as parties to the petition and issued notices to them. Their Indian subsidiaries had responded to the petition.

Earlier, lawyer Virag Gupta, arguing for the petitioner, said the agreements entered into by minors here with the sites were against the Indian Majority Act, the Indian Contract Act and the Information Technology Act. In June 2012, Facebook, in a statement filed before the U.S. Securities and Exchange Commission, said that more than eight crore of its registered users had given false identities. This might have further increased, he noted.

The government had framed detailed guidelines for ‘Know Your Customer’ norms for all sectors and more specifically for verification of mobile subscribers by telecom companies. However, these norms were not being followed by the sites, thus posing a grave security risk to the nation, he added.

He also raised the issue of invasion of privacy of users of the sites as their data was being transferred to the U.S. for commercial use.

Cyber law experts say that there may be merit in the petition, as misrepresentation can invite penal action. “Creating a false electronic record is an offence under the Information Technology Act and the Indian Penal Code. Under Section 465, the offence would attract punishment up to two years’ imprisonment and if the account so opened is used for the purpose of cheating, it would be punishable with a maximum of seven years’ imprisonment,” said top cyber law expert Pavan Duggal.

Children “openly lying about their age to create accounts on these websites” were likely to face potential legal exposure” and even parents “who knowingly misrepresent information about their children while opening accounts in their names,” could be prosecuted under the IPC and the IT Act. “Ignorance of law is no excuse,” he said.

The cyber law expert added that the online contract between users and social networking sites is enforceable in India. Therefore, under Indian law, both sides must be competent to contract, which means that they must be adults and of sound mind and the contract must be for lawful purposes. “Therefore, any [online] contract with a minor is null and void under the Indian Contract Act. While the age of majority in India is 18 years, it varies from country to country,” Mr. Duggal said.

Bollywood actor Aamir Khan is all set to play a gymnast in Dhoom 3 and is reportedly shooting in circus tents.

According to the report published by a leading publication Mr. Perfectionist is shooting for his introduction song as well as several scenes for Vijay Krishna Acharya's thriller Dhoom 3 at Film City.

The leading tabloid quoted a source as saying, "He will be indulging in trapeze and mid-air acts for the shoot. The place has been booked for a good long 40 days. European dancers and performers will be performing with him in the song.

"Aamir is seen pumping iron around the sets. He wants to be fit as a fiddle. He has been training day in and day out for his look keeping his diet in check despite his other commitments," the source added.

The film slated for December 25th release will see Abhishek Bachchan and Uday Chopra reprising their roles as Jai Dixit and Ali Khan respectively along with diva Katrina Kaif.

It's a double delight for all Rajinikanth fans who have been dying to get a glimpse of the Southern superstar's character in his much-awaited film Kochadaiyaan. 

The first official picture of the characters played by Rajinikanth, tweeted  by his daughter Soundarya Ashwin, shows Rajinikanth flaunting two avatars. While one is reported to be Kochadaiyaan, a loyal commander of a great emperor,  the other is his son Rana, a warrior. 

An earlier poster of the film had seen Rajinikanth sporting six packs.

Kochadaiyaan, the directorial debut of Soundarya, is the actor's first film after recovering from a kidney ailment.

One of the most-awaited movies this year, Kochadaiyaan is in the post-production stages and is likely to hit the screens in July 2013.   

The film will be a hi-tech 3D film and will be the first in India to use performance capturing technology. James Cameron's mega hit Avatar and Steven Spielberg's The Adventures of Tintin were made with the same technology.

The film also stars R Sarathkumar, Aadhi, Deepika Padukone, Shobana, Rukmini Vijayakumar, Jackie Shroff and Nassar. 

The film's background score and soundtrack has been composed by Oscar winning composer AR Rahman. It will be dubbed and simultaneously released in Telugu as Vikrama Simha, Malayalam and English, and will also be released in Hindi and Japanese

A strapping, beefy soldier on a mission takes on a particularly repugnant small-town rogue to keep a pretty damsel out of harm’s way in this predictably visceral action flick that plays out more like a violent cut-and-thrust computer game than a movie about real, believable people.
While the stunt scenes are impressively staged and filmed, the good versus evil confrontation is as old as the stunning peaks and vales around which the action unfolds.
The adrenaline-pumping Commando – A One Man Army arouses about as much emotion as an early morning jog on a treadmill.
Produced by Vipul Shah and directed by Dilip Ghosh, the film un-spools at a fair clip (if you discount a ridiculously out-of-place love ditty in the first half and a gratuitous item number in the second), but it makes no impression either on the mind or the heart.
The film alludes to the “ten thousand” power-crazed, greedy people who have been gnawing at the entrails of the nation, but the well-meaning spiel somehow rings hollow amid all the vacuous hullabaloo that Commando rustles up.
As the male protagonist puts it through a stray line of dialogue, the law of the jungle prevails here. You either kill or get killed. So, even if you were to treat this as a game of cat and mouse, it would run out of surprises within the first 30 minutes.
When the film opens, the hero, Karan Vir Dogra (Vidyut Jamwal) of the 9 Para Commandos of the Indian Army, is in a Chinese army prison. He has been captured on suspicion of being on an espionage mission.
A slimy minister (neither his portfolio nor is location is specified with any clarity) orders the commando’s officer, Colonel Akhilesh Sinha (Darshan Jariwala), to erase the man’s name from the rolls in order to prevent the China from using him as a political pawn.
The colonel launches into a passionate eulogy on the commando’s many physical and mental virtues and his superhuman powers of endurance to make a case for a rescue mission.
The politician responds with utter nonchalance: “The nation is more important than a soldier.” The officer has no answer.
After braving all manner of third degree torture for a year in a dark and dank prison cell, the unbreakable commando manages to escape, with hatred embedded in his heart for the rulers of the nation.
He makes it over the border into a nondescript Punjab town that is lorded over by a brutal hoodlum named Amrit Kanwal (Jaideep Ahlawat), who calls himself AK-74 because he was born on a moonless night that year.
Politicians and policemen do the baddie’s bidding. He also has his sights on the town’s hottest lass, Simrit Kaur (Pooja Chopra), and is bent upon marrying her.
The girl takes to her heels and runs into the commando, who himself is on the run from a variety of foes.
The rest of the film is a string of chases and bloody skirmishes in the jungle that leave a trail of corpses.
The protagonist is a man of few words and expresses himself mainly through his prowess as a hand to hand combatant.
One can say pretty much the same about the film itself: it allows the action to take precedence over character development.
So the dramatis personae aren’t flesh and blood figures the audience can develop any empathy with. The hero is an automaton-like terminator, the villain, a man born without pupils in his eyes, is a complete caricature and the motor-mouth female protagonist is pretty and pretty dumb.
There is no denying that both Jamwal and Ahlawat, each in his own way, have tremendous screen presence.
Jamwal does make a good action hero because he isn’t just brawn. He also has expressive eyes that can be put to infinitely better use than they are here.
Ahlawat’s venal villain, who reads SMS jokes to his human quarries and cracks up before he kills them, is more funny than menacing.
The two actors would be better advised to choose better vehicles than this film to display their wares.
Despite all the bravura technical effort that has clearly been put into Commando, the end result simply isn’t compelling enough to merit more than TWO STARS.

Back in the ’90s, Govinda was nothing short of a superstar. However, after a string of flops in the 2000s, he fell off the map. Amid several forgettable appearances, he had one major film to his credit: Partner (2007), with Salman Khan. Since then, he has had 11 releases. But barring Life Partner(2010) and some critical acclaim as a forest department official in Mani Ratnam’s Raavan (2010), there’s been little worth writing about.



Now, with the actor desperately in need of a good project, the man coming to his rescue again seems to be Salman. On April 10, the two were spotted at the screening of director Mahesh Manjrekar’s new Marathi film, Aajcha Divas Majha, at Ketnav Theatre in Bandra. It made us curious. And on looking into it, we found out that Salman has apparently agreed to star in and produce a film with Govinda. “Salman is eager to take his production house forward after Chillar Party (2011). Mahesh has discussed a project with Salman and Govinda,” says an insider. 


A couple of years ago, Mahesh had announced the Hindi remake of his Marathi directorial venture, Shikshanachya Aaicha Gho (2010). He had apparently offered Govinda the lead role then, with Salman Khan Being Human Productions Productions (SKBH) on board. Govinda is believed to have turned down the offer as he did not like the concept.


However, the new film being talked about now seems to be a different one. “It isn’t Shikshanachya… It’s another film, which has appealed to both the actors,” the source adds.

When contacted, Govinda says, “Yes, Salman, Mahesh and I have had meetings to discuss a project, which is in the pipeline. As and when it works out, it will be announced. I want to make a proper comeback, and need a good platform.”

Currently, the only project Govinda is working on is a remake of Avtaar (1983 Rajesh Khanna-starrer), helmed by Pahlaj Nihalani, who directed the original.

NEW DELHI (Reuters) - Police in India are investigating to determine whether U.S. Internet company Google Inc violated rules in a competition that asked users to add information about their local areas for its online map services after a government agency raised security concerns.

Google, which ran the "Mapathon" in India in February and March, said its aim was to make more local information accessible to all and that it did not break any laws.

Police are acting on a complaint filed by Survey of India, the country's national survey and mapping agency, which said the contest was illegal and may threaten national security.

"One complaint has been received and we are forwarding it to the cybercell for further action," said Chhaya Sharma, a deputy commissioner of police in New Delhi.

Google officials said the company had not yet received an official communication from the police.

Google invited users to help "create better maps for India" by adding knowledge of their neighborhoods and promised the top 1,000 mappers prizes of tablets, smartphones and gift vouchers.

Survey of India first wrote to Google saying its "Mapathon" was against rules and then filed a police complaint, R.C. Padhi, a top official at the agency, told Reuters.

"We have to ensure that security is not compromised at any cost," Padhi said, adding that some information uploaded on Google Maps could be "sensitive".

Google is open to discussing specific concerns over the issue with public authorities in India, Paroma Roy Chowdhury, a company spokeswoman in India said in a statement.

"Google takes security and national regulations very seriously, and the Mapathon adhered to applicable laws," Roy Chowdhury said.

LATEST IN SERIES OF DISPUTES

The investigation is the latest in a series of disputes between various governments and Google over privacy and security issues involving its popular mapping products.

In March, Google agreed to pay $7 million in the United States to settle an investigation into an incident in which its Street View mapping cars allegedly collected passwords and other personal data from home wireless networks between 2008 and 2010.

In 2011, city police in the southern Indian technology hub of Bangalore ordered Google to suspend a Street View service over security concerns, three weeks after the company started collecting images from the city.

Tarun Vijay, a lawmaker from India's main opposition Bharatiya Janata Party, last month complained to the government over the "Mapathon" contest.

"Will we allow any Indian organization to invite people for mapping their localities and have entire data stored in USA? Special to Google?," Vijay wrote on the Twitter social networking site on March 20.

"If there is a law, it has to be followed. I have asked whether Google followed the law," Vjay told Reuters on Friday, after meeting India's defense and interior ministers over the issue. "I have taken up that they should be acting urgently."

Separately, Google and other social media companies are also fighting a criminal case brought by an Indian journalist related to allegedly "offensive" content on their web sites.

Mumbai: Animation production house Toonz has partnered with Cartoon Network and Bollywood director Rakesh Roshan`s Film Kraft Productions to produce four animated movies based on the Hindi blockbuster superhero `Krrish`.

Roshan`s `Koi... Mil Gaya` and `Krrish` went on to become the first superhero films of Hindi film industry. The series will soon have a third film `Krrish 3`, starring Hrithik Roshan again.

"The animated `Krrish` franchise are fun films that are guaranteed to be a visual treat with mass appeal. We are thrilled about partnering with the legendary Rakesh Roshan and Cartoon Network," Toonz Animation India Chief Executive P Jayakumar said after announcing the pact.

The animated movie follows the childhood adventure of Krishna, who discovers that he can help people and save the world with the special powers bestowed upon him.

Under the agreement, a series of four movies will be created in the next 24 months, the first of which, titled `Kid Krrish`, will be air on Cartoon Network on July 14, Jaykumar said.

"The Krrish franchise has been very well received by kids across the country and we are certain that they will be enthralled and excited to watch this adaptation of their superhero on Cartoon Network," Turner International India Managing Director for South Asia Siddharth Jain said.

Launched in 1995, Turner Broadcasting System, Inc`s Cartoon Network is a leading kids` entertainment channel in India, and claims to have over 33 million viewers across the country.

"Since `Krrish 3` will be ready for release this Diwali, I wanted to revive the memory of `Krrish` with children and the newer generation who may have not seen `Koi Mil Gaya` or `Krrish`. I am happy to have collaborated with Turner and Toonz Animation," Roshan said.

The new movie stars Hrithik, Priyanka Chopra, Kangna Ranaut and Vivek Oberoi in lead roles.
